On February 6, 2026, Alston & Bird achieved a legal win for a global skin care company in a proposed nationwide class action lawsuit. The case centered on claims that the label “Natural Moisturizing Factors Enriched” on certain lotions was misleading because the products contained synthetic ingredients.
Judge April M. Perry of the Northern District of Illinois dismissed the plaintiff’s arguments. The court ruled that the plaintiff could not interpret the word “natural” by itself and found her claims implausible even under her own definition of “natural.” Additionally, Judge Perry determined that the plaintiff did not show any actual injury and did not have standing to bring claims regarding lotions she had not purchased.
The legal team from Alston & Bird representing the skin care company included partners Beth Chiarello and Kara McCall, counsel Caitlin Maly, and senior associates Matt Binder and Matt Atha from the Mass Torts & Toxic Torts group.
