A legal team from Gibson Dunn achieved a significant victory for Cisco and Duo in a recent patent infringement case. The case, brought by CosmoKey, involved allegations of patent infringement concerning verification technology. CosmoKey sought nearly $140 million in damages and a running royalty.
The trial lasted five days, after which the jury returned a verdict favoring Cisco and Duo on all claims. These included non-infringement, prior commercial use by the defendants, and the invalidity of the patent in question.
“This is believed to be only the second-ever verdict of prior commercial use under 35 U.S.C. ยง 273(a) since its enactment more than a decade ago,” stated representatives from Gibson Dunn. They also noted that “the first occurred earlier in 2025, also with partner Brian Rosenthal as lead counsel.” This recent win marks Cisco’s third consecutive patent trial victory this year with Rosenthal at the helm, following successes in January and February.
The successful trial team was composed of partner Jaysen Chung along with associates Nathan Scharn, Yana Nebuchina, Erin Kim, and Julian Manasse-Boetani.
