Gibson Dunn’s partner, Jason Schwartz, recently discussed the uncertainty surrounding transgender rights in the workplace with Law.com. This follows a Texas judge’s decision to strike down portions of the Equal Employment Opportunity Commission’s anti-harassment guidance.

Schwartz highlighted the challenges employers face due to this ruling. He stated, “there is no clear statement of what the law is. I don’t think there will be until these issues percolate all the way up to the Supreme Court.” Schwartz serves as Co-Chair of Gibson Dunn’s Labor & Employment Practice Group.
