Gibson Dunn partners have highlighted key environmental, health, and safety (EH&S) considerations that can significantly impact mergers and acquisitions (M&A). Writing in The M&A Lawyer, Michael K. Murphy, Rachel Levick, along with associates Taylor C. Amato and Phil Washburn, emphasized the importance of early identification of EH&S issues to help buyers evaluate potential problems and develop effective solutions.

“It is therefore important to engage environmental subject matter experts early in the deal process,” they advised. This proactive approach allows for a thorough evaluation of compliance with relevant EH&S laws and an assessment of liability risks.
